The petitioners seek bail in Dumariyaghat P.S.Case No.146 of 2018 registered under Sections 413, 414 of the I.P.C. and Sections 25(1-b)a, 26, 35 of the Arms Act. Allegation against the petitioner is recovery of LapTop of acer Company and Mobile of Android Company with duel SIM from the possession of the petitioners. It has been submitted on behalf of learned counsel for the petitioners is that they are innocent and they have been falsely implicated in this case. They are in custody since 31.08.2018.
Considering the facts and circumstances of the case, as stated above, let the petitioners, above named, be released
Patna High Court Cr.Misc. No.69773 of 2018(2) dt.06-12-2018 2/2 on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of 1st Additional Chief Judicial Magistrate, East Champaran at Motihari, in Dumariyaghat P.S.Case No.146 of 2018 subject to the conditions that (1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and their absence on two consecutive dates without sufficient reason, their bail bonds shall be cancelled by the court below and (3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
