JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-05-2019 The learned counsel for the petitioner submits that the case of the petitioner is squarely covered by a judgment rendered in the case of Vishwanath Pandey v. The State of Bihar & Others, reported in 2013(3) PLJR 305 (SC). Per contra, the learned counsel for the respondents submits that the respondent no. 6 could verify as to whether the case of the petitioner is covered or not.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to direct the petitioner to file a representation before the respondent no. 3 within a period of four weeks from today and the respondent no. 3 shall dispose of the same by a reasoned and speaking order within a period of eight weeks thereafter and in case, the case of the petitioner is
Patna High Court CWJC No.10634 of 2019(3) dt.17-05-2019 2/2 found similar to that of the petitioner of the aforesaid judgment rendered in the case of Vishwanath Pandey vs. the State of Bihar & others (supra), similar relief would be granted to the petitioner herein within a period of six weeks therefrom.
