JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-420, 468, 469, 471, 472, 34 of the Indian Penal Code. One person was caught carrying forged Sim cards and, on the basis of his disclosure, the shop of the petitioner was raided and, some Sim cards and photographs of several persons without having any name and address were recovered from the shop of the petitioner. The petitioner is languishing in jail custody since 3108-2016 and does not have any criminal antecedent. Submission on behalf of petitioner is that no forged Sim card has been recovered from shop of the petitioner and mere recovery of some photographs does not show the involvement of

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khusrupur P.S. Case No. 57 of 2016 to the satisfaction of Sri Ashutosh Kumar Rai, learned Judicial Magistrate-Ist Class, Patna City.
