In this case, the petitioners are seeking anticipatory bail in connection with Special Case No.1022 of 2019, arising out of Didarganj P.S. Case No. 29 of 2019, registered for the offence under Sections 30(a), 38 (1) of the Bihar Prohibition and Excise Act.
The Police has received secret information that certain persons are engaged in illegal trade of liquor, accordingly, the Police party has gone to Mohalla-Didarganj. Upon seeing Police Party, certain persons fled away from there, under suspicion the Police Party entered into the house of the
Patna High Court CR. MISC. No.19882 of 2019(2) dt.01-04-2019 2/2 petitioners and on search about 48 liters of foreign liquor has been recovered from a hut situated on the top of the house. Learned counsel for the petitioners submits that the house of the neighbour of the petitioners was also raided and the persons of that house, who have been made accused in Didarganj P.S. Case No.28 of 2019, while fleeing away from the house have thrown the liquor in the hut of the petitioners. Considering the fact that the liquor as well as the Voter Cards of the petitioners have been recovered from their house, this Court is not inclined to grant bail to the petitioners. Accordingly, their prayer for bail is rejected. (Shivaji Pandey, J) pawan/- U T
