Petitioner seeks bail in connection Sursand P.S. Case no. 19 of 2021 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 13.01.2021 and charge sheet has been submitted. He further submits that allegation is of recovery of 108 liter Nepali Saufi from seat of the motorcycle. Learned counsel submits that motorcycle does not belong to the petitioner.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody since 13.01.2021 and charge sheet has been submitted,

Patna High Court CR. MISC. No.34370 of 2021(2) dt.01-12-2021 2/2 petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge (Excise), Sitamarhi in Sursand P.S.
