The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 308, 337, 338, 324, 354, 504 and 506/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner assaulted the informant and his family members and the petitioner also assaulted on the head of daughter of the informant with khanti causing fracture on her head.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The

Patna High Court Cr.Misc. No.43992 of 2016 (3) dt.22-11-2016 2/2 nature of injury is said to be simple. No offence under Section 307 I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Barhara P.S. case No.170 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
