During course of conduction of raid at the garage of Taapas Kumar Mitra @ Chhotu Mistri, one Bolero and one Tata Indica car was found parked having one person at driving seat who were interrogated and further, on search 20 bottles of Royal Stag wine was found. In likewise manner, from the Tata Indica car 18 bottles of Royal Stag wine was found. Petitioner happens to be occupant of the Bolero, while Taapas Kumar Das was occupant of TATA Indica. Furthermore, it has also been disclosed that Sujan Saha had made inculpatory extra judicial confessional statement wherein he had admitted that he brought the aforesaid bottles of wine from West Bengal, and sold it to the petitioner alongwith others who happen to be engaged in unauthorized business of wine.
From para 3 of the petition, it is evident that petitioner has got no criminal antecedent and he is under custody since 31.7.2016.
Patna High Court Cr.Misc. No.40039 of 2016 (2) dt.17-09-2016 2/2 Accordingly, petitioner Shiv Gopal Jaiswal, is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount to the satisfaction of the Learned Chief Judicial Magistrate, Araria, in connection with Forbisganj P.S. Case No. 377 of 2016.
