Dead body of unknown female was found by the side of a railway track near Ganga Sarai Halt, on account thereof, F.I.R. has been registered against unknown on the written report of Chaukidar, Mukesh Paswan.

It is evident from the case diary that at second leg of investigation, presence of petitioner along with his sons (Para-17) appeared whereunder they identified the dead body to be that of Anju Kumari, who was an A.N.M.R.

No concrete, positive evidence has been collected by the I.O. against the petitioner though chargesheet had already been submitted to connect his complicity with the alleged crime, save

Patna High Court Cr.Misc. No.51710 of 2016 (04) dt.11-01-2017 and except being husband of the deceased as well as brother of deceased (Para-61), shown some sort of suspicion. Accordingly, petitioner, Navin Prasad Singh @ Navin Prasad Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P. S. Case No.21 of 2016.
