The petitioner seeks bail in Deodha P. S. Case No. 97 of 2018 instituted for the offence under Section(s) 272, 273, and 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016 .

In the written report, it is alleged that police has arrested three persons and 36 litres of Nepali liquor has been recovered from possession of each of those persons. Petitioner is one of the person alleged to have been apprehended by the police.

Petitioner is in custody since 5.9.2018.

It is mentioned in para 3 of the bail petition that one

Patna High Court Cr.Misc. No.71375 of 2018(3) dt.10-12-2018 2/2 another case under the Excise Act is also pending against this petitioner.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the IInd Addl. District and Sessions Judge cum Special Judge, Excise Act, Madhubani, in connection with Deodha P. S. Case No. 97 of 2018 , G.R. No. 1260 of 2018 , subject to the condition that both the bailors shall be the close relative of the petitioner.

The petitioner will file affidavit at the time of release that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activities , his bail bond will be liable to be cancelled.
