2. The petitioner is in custody in connection with Bachhawara P.S Case No. 372 of 2023 from the Court of learned A.C.J.M, Teghra, Begusarai registered for the offences punishable under Sections 302, 201/34 of the I.P.C.

3. As per prosecution case, it is alleged that accused persons came and taken the husband of the informant and on very next morning his dead body was found. Informant believed that accused persons killed her husband.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is also submitted that petitioner is in judicial custody since 25.11.2023 and petitioner has got no criminal antecedent as stated in para 3 of the petition.

5. However, learned APP for the State oppose the

Patna High Court CR. MISC. No.27560 of 2024(3) dt.28-06-2024 2/3 prayer for regular bail of the petitioner.

6. On perusal of the first information report, impugned order dated 22.01.2024 and the case diary, it appears that witness examined by Investigating Officer and stated about the involvement of the present petitioner along with other accused persons in this case. It also appears that informant's mother-in-law, Kajoma Devi in para 51 of case diary stated that at around 10-11 PM, Chandan Sahni came at her house and asked Ajay Uncle to come to Ghat and while she was awake till 12 her son didn't return to house and their neighbor Shankar Sahni also stated in para 53 of case diary that he has seen the petitioner calling deceased in front of informant's house and taking deceased along with him. Other witnesses have also supported the allegations levelled against him in Para nos.

Patna High Court CR. MISC. No.27560 of 2024(3) dt.28-06-2024 3/3 Court is not inclined to grant bail to the petitioner.

7. Hence, the prayer of regular bail of the petitioner is hereby rejected.
