2. The petitioner prays for grant of anticipatory bail apprehending his arrest in connection with Motihari Town P.S. Case no. 540 of 2022 registered under section 379 of the Indian Penal Code.

3. As per the prosecution case, some documents from the Court which were sent to the Turkauliya Block and which were received by the Jeep Driver ie the petitioner herein in presence of the Block Development Officer, Turkauliya, were found to be missing.

4. Learned counsel for the petitioner submits that from the contents of the FIR it would transpire that the so called documents were allegedly received by the petitioner in presence

Patna High Court CR. MISC. No.28617 of 2023(3) dt.11-09-2023 2/2 of the Block Development Officer, Turkauliya. The petitioner has neither any concern nor any knowledge about the whereabouts of the documents nor has anything transpired in course of investigation to support the allegation as to how the petitioner is benefited out of the disappearance of those documents. The petitioner has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR together with the petitioner not having any criminal antecedent, it is directed that in the event of his arrest or surrender within four weeks, the petitioner be enlarged on bail in connection Motihari Town P.S. Case no. 540 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari.
