Mr. Sanjay Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 16-07-2026 Heard learned counsel for the petitioner, learned APP for the State, perused the case diary as well as the statement of the victim girl.

2. The petitioner is in custody in a case registered for the offence punishable under Sections 96 and 3(5) of the BNS.

3. As per allegation in the FIR, it is a case of abduction of the daughter of the informant by the petitioner and other co-accused persons.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that both the parties are own gotias and due to his domestic dispute, this false case has been instituted and

Patna High Court CR. MISC. No.22353 of 2026(4) dt.16-07-2026 2/2 implicated this petitioner and he is in custody since 17.12.2025.

5. Learned APP for the State has opposed the prayer for bail of the petitioner.

6. On perusal of the first information report, case diary, the statement of the victim girl recorded under Section 183 of the BNSS and impugned order dated 11.03.2026, the victim has stated that the petitioner is my uncle and he used to come my house and there is no sexual assault upon the victim and petitioner had dropped the home, so I am inclined to grant bail to the above named petitioner.

Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cumSpecial Exclusive Judge (POCSO), Aurangabad in connection with Deo P.S. Case No. 305 of 2025, POCSO G.R. No.11 of 2026.
