The petitioner apprehends his arrest in connection with Gurua P.S. Case No. 140 of 2016, registered under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that on the joint prayer of the learned counsel for the petitioner and the opposite party no. 2, the matter was referred to the Mediation Centre, Patna High Court, for settlement of dispute in between the petitioner and the opposite party no. 2, who are husband and wife, where both parties appeared and settled their dispute in terms of agreement to live separate with condition that petitioner will pay Rs.1,75,000/- to the opposite party no. 2, out of which,

Patna High Court Cr.Misc. No.8329 of 2017 (4) dt.02-11-2017 Rs.1,25,000/- has already been deposited in the account of opposite party no. 2 and remaining Rs.50,000/- is to be paid at the time of evidence in Divorce Case, which would appear from the agreement dated 17.10.2017 which is a part of mediator's report dated 30.10.2017.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Sherghati, Gaya, in connection with Gurua P.S. Case No. 140 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
