Petitioner, who is in custody, seeks bail in connection with K. Hat P.S. Case No. 380 of 2018 registered for the offences punishable under Sections 353, 332, 379, 504 and 34 of the Indian Penal Code and under Section 4 of Bihar Medical Protection Act, 2011.

Informant who is a Medical Officer of Sadar Hospital, Purnea has alleged that a patient in serious condition had come to the hospital who was referred for higher center because of seriousness of his condition. Petitioner and others humiliated, assaulted and abused him. Petitioner create obstruction in smooth functioning of the Government hospital and also threaten to kill him and he was apprehended at the

Patna High Court Cr.Misc. No.67602 of 2018(2) dt.28-11-2018 2/2 place of occurrence when the matter was reported to the police. It has been submitted on behalf of the petitioner that he is innocent. He has no criminal antecedent and he is in custody since 03.06.2014.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat P.S. Case No. 380 of 2018.
