03-12-2018 Heard Sri Vijay Kumar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 28-05-2018 in Special Case No. 55 of 2018, arising out of Punpun P.S. Case No. 140 of 2018 registered for offence under Sections 20/22 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail on two counts. Firstly, it has been argued that there is recovery of small quantity of ganja to the tune of 250 gm and secondly, it has been argued that one of the co-accused namely Md. Chand, from whose possession there was recovery of 300 gm of ganja, has been granted bail, in view of order dated 07-08-2018 passed in Cr. Misc. No. 48698 of 2018.

Patna High Court Cr.Misc. No.70721 of 2018(2) dt.03-12-2018 2/2 48698 of 2018, co-accused (Md. Chand) was directed to be released on bail after framing of the charge. Learned counsel for the petitioner has drawn my attention to statement made in paragraph - 11 of the petition to show that in the case, charge has already been framed and after framing of the charge, co-accused Md. Chand has already been released from judicial custody.

Considering the fact that it was a case of small quantity of ganja as well as the fact that one of the co-accused has already been granted bail, there is no reason to further detain the petitioner, who is a lady.

Let the petitioner namely Paro Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - X, Patna in connection with Special Case No. 55 of 2018, arising out of Punpun P.S. Case No. 140 of 2018.
