JUSTICE SANJAY PRIYA ORAL ORDER 10-01-2017 Heard learned Counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 461, 379 and 411 of the Indian Penal Code.

It is alleged that 121 mobile sets of Samsung and Nokia companies were stolen from the shop of the informant by some unknown persons.

From perusal of the order of the District and Sessions Judge, Samastipur, it appears that the name of the petitioner has come in the confessional statement of co-accused Umesh Kumar Sharma who is son of the petitioner. There is no recovery of any incriminating article from the possession of the petitioner and the petitioner is said to have remained in custody since 28.6.2016.

No.45034 of 2016 (3) dt.10-01-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Samastipur town P.S. Case No. 362 of 2013, subject to the condition that both the bailors will be the close relatives of the petitioner.
