Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Barachati P.S. Case No. 547 of 2020 for the offence punishable under Sections 147, 148, 149, 332, 333, 307, 353, 120-B, 427 of the Indian Penal Code and under Section 3 of Damage to Property Act.
Patna High Court CR. MISC. No.33184 of 2021(3) dt.23-03-2022 2/3 Learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no. 1 and 3, above named.
Accordingly, this bail application is dismissed as withdrawn as against petitioner no. 1 and 3, above named. The petitioners are said to have assaulted the police personnel.
It has been submitted by learned counsel for the petitioners that the petitioners are not involved in this case and their names have only come on suspicion.
Considering the aforesaid facts, this anticipatory bail application is allowed.
Let the petitioner nos. 2, 4 to 8, above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barachatti, Disttrict- Gaya, in connection with Barachati P.S. Case No. 574 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
