JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and some others were caught while they had assembled to make preparation for committing dacoity and on being searched, one cartridge, some cash and one gold ear-ring were recovered from conscious possession of the petitioner and, after that, petitioner confessed his guilt disclosing his involvement in the present crime. Except the aforesaid material and some criminal antecedent, there is nothing against the petitioner. No doubt, some articles, which had been recovered from possession of other accused, were put on T.I.P and the witnesses claimed to have identified the said articles but para- 102 of the case diary goes to show that the seized ear-ring had not been

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Civil Line P.S. Case No. 92 of 2016.
