JUSTICE SANDEEP KUMAR ORAL ORDER 23-05-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sahebganj P.S. Case No. 289 of 2021 for the offence under Sections 341, 323, 324, 354B, 504, 379, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 12.01.2023.

It is alleged that petitioner along with accused persons armed with lathi, rod and knife arrived at informant's house and assaulted her by pulling her saree and stabbed her with knife. The present F.I.R is not registered under Section 307 of the Indian Penal Code against the petitioner but charge-sheet has been submitted by police under Section 307 of the Indian

Patna High Court CR. MISC. No.26287 of 2023(2) dt.23-05-2023 2/2 Penal Code. The petitioner is said to have assaulted and injured with knife causing grievous injury to the informant. Considering the fact that the petitioner has got no criminal antecedent and period of custody, the petitioner, named above, is directed to be released on bail after completing nine months in judicial custody on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur (West) in connection with Sahebganj P.S. Case No. 289 of 2021.
