Petitioner is accused in connection with S. Tr. No. 685 of 2015 arising out of Samastipur Muffasil P.S. Case No. 258 of 2015 registered under Sections 302, 120(B)/34 of the I.P.C. and 27 of the Arms Act.

According to F.I.R., the petitioner and co-accused Kamal Mahto took the deceased Sintu Kumar from his house for settlement of accounts. Later on, dead body of Sintu Kumar was found at the general store of petitioner Chandan Kumar. The witnesses have stated that petitioner and co-accused Kamal Mahto were fleeing from the place of occurrence along with fire arm. Submission of learned counsel for the petitioner is

Patna High Court Cr.Misc. No.42123 of 2016 (3) dt.13-12-2016 2/2 that there is no eye witness of actual occurrence. There is allegation of conspiracy. Further submission is that charge has already been framed in this case and petitioner is ready to cooperate with the trial. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-4th, Samastipur in connection with Sessions Trial No. 685 of 2015 arising out of Samastipur Muffasil P.S. Case No. 258 of 2015, subject to the condition that the petitioner will fully co-operate with the trial.
