JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-08-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Saraiya P.S. Case No. 111 of 2020 for the offence under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that in the instant case the petitioner and others have been apprehended by the police on the allegation that they were preparing for committing crime. From possession of the petitioner, one magazine and mobile phone was recovered. Petitioner is in custody since 22nd February, 2020.

Considering the fact that the petitioner has has remained in custody for about six months, the Court is inclined
