JUSTICE SANJAY PRIYA ORAL ORDER 2/ 17-04-2019 This application has been filed for modification of the order dated 06.09.2018 passed in Cr. Misc. No.54834 of 2016. Counsel for the Petitioner submits that Matrimonial Case No.08 of 2014 is pending before the Principal Judge, Family Court, Sitamarhi, for grant of maintenance. There was also order for payment of interim maintenance @ Rs.4,000/- per month by 12th of every month to the Petitioner by the Opposite Party No.2.

The Opposite Party No.2 earlier moved this Court vide Cr. Misc. No.54834 of 2016, which was disposed off by order dated 06.09.2018 with direction to the Principal Judge,

Patna High Court CR. MISC. No.23159 of 2019(2) dt.17-04-2019 2/2 Family Court, Sitamarhi, to dispose off the matrimonial case expeditiously within a period of six months from the date of receipt of copy of the order.

Counsel for the Petitioner submits that neither Opposite Party No.2 is making payment of interim maintenance nor final order has been passed in the case.

In such circumstances, this Court directs the Principal Judge, Family Court, Sitamarhi, to proceed with Matrimonial Case No.08 of 2014 in accordance with law and make all efforts to conclude the same as early as possible in terms of the direction given in order dated 06.09.2018 passed in Cr. Misc. No.54834 of 2016.

The Principal Judge, Family Court, Sitamarhi, will take all appropriate steps in accordance with law to ensure that at least amount of interim maintenance is paid to the Petitioner within a period of three months from the date of receipt/production of a copy of this order.

This Modification Application is, accordingly, disposed off.
