Although instant case was registered on the basis of complaint petition but there is allegation against the petitioner that he and one co-accused Krishna Rawat took the informant towards a hillock and not only assaulted, looted but co-accused Krishna Rawat committed rape upon her.
The case has been registered under the provision of the SC/ST (Prevention of Atrocities) Act. Therefore, in my view, section 18 of the SC/ST (Prevention of Atrocities) Act, 1989 is applicable and this anticipatory bail petition is not maintainable. Accordingly, this petition filed in connection with Jamui Mahila P. S. case no. 23/2014 stands
Patna High Court Cr.Misc. No.595 of 2015 (2) dt.08-01-2015 dismissed being not maintainable.
