The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The petitioner is not named in the FIR. The son of the deceased did not name the petitioner. During course of investigation the name of the petitioner transpired and it has come that the petitioner had also advanced money to the deceased and for that the deceased was killed.

It is submitted that the petitioner has got criminal antecedent, but the petitioner has already been acquitted in all the 14 cases pending against the petitioner except one Gopalpur P.S. Case No. 25 of 2006, registered under Sections 384, 379 and other

Patna High Court Cr.Misc. No.43553 of 2015 (3) dt.23-11-2015 2/2 Sections of the Indian Penal Code.

Having considered the facts aforesaid and the fact that the petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order.
