JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-06-2019 This application, for grant of anticipatory bail, arises out of Bhadwar P.S. Case No. 17 of 2018, disclosing offences under Sections 147, 148, 341, 323, 325, 338, 307 and 504 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
Prosecution case is that when the informant stop the petitioner and others from selling the liquor, they assaulted him by fists and slaps and also dashed him from their motorcyle causing fracture injury to him.
Submission of learned counsel for the petitioner is that he has no criminal antecedent and he has falsely been made accused in this case and no specific allegation has been attributed to him and further no liquor has been recovered from the conscious possession of the petitioner.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Bhadwar P.S.
