Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. It is a case of misuse of privilege of bail. Bail bond of the petitioner was cancelled on 23rd November, 2007 at the stage of prosecution evidence. Besides the petitioner one more accused is facing trial. The impugned order reveals that the case is at the end of evidence.
The court below is directed to expedite the trial and conclude the same within three months from the date of receipt of a copy of this order without giving any unnecessary adjournment to any of the parties and if the trial is not concluded within the aforesaid period, the petitioner may renew his prayer
Patna High Court Cr.Misc. No.46264 of 2016 (3) dt.14-12-2016 2/2 for bail before the learned court below itself. With the aforesaid observation, the application stands disposed of in connection with S.T. No. 450 of 2005 arising out of Dharhara Police Station Case No. 68 of 1997 pending in the court of learned Sessions Judge, Munger.
