The petitioner seeks regular bail in connection with Industrial Area P.S. Case No. 32 of 2017, registered for the offence punishable under Sections 382 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that petitioner is not named in the written report. No T.I.P. has been held. There is no recovery of any incriminating article from possession of this petitioner. The name of this petitioner has come in the confessional statement of co-accused, namely, Bipin Kumar. Thereafter, petitioner has been remanded in this case. It is further submitted that similarly

No.72305 of 2018(2) dt.12-12-2018 2/2 situated co-accused persons have been granted bail vide order dated 06.11.2018 passed in Criminal Miscellaneous No. 67513 of 2018 and vide order dated 27.11.2018 passed in Criminal Miscellaneous No. 68758 of 2018. The petitioner is in custody since 22.02.2018.

Having regard to the facts and circumstances of the case as also the fact that similarly situated co-accused persons have been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 32 of 2017.
