The petitioner is apprehending his arrest in Khaira P.S. Case No. 221 of 2020 registered for the offence under Sections-304B, 120B/34 of the Indian Penal Code, 1860 (hereinafter 'IPC').

Earlier prayer for anticipatory bail of the petitioner was rejected by this court vide order dated 08-04-2021 passed in Cr. Misc. No. 17081 of 2021 taking into account that there was specific allegation against the present petitioner. I find no merit in the second anticipatory bail application filed on behalf of the petitioner. Accordingly, the same is rejected.

However, if the petitioner surrenders in the court

Patna High Court CR. MISC. No.22109 of 2022(3) dt.15-02-2023 2/2 below and seeks regular bail, the same shall be considered on its own merit without being prejudiced by this order and the same be disposed of preferably on the same day.
