The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Gobindganj (Areraj) P.S. Case No. 109 of 2015 registered under Sections 363, 364, 366, 34 of the I.P.C.

The accusation is that Ruchi Kumari aged about 14 years, daughter of the informant, moved on 02.05.2015 in the morning to pluck the flower but she did not return. Thereafter, the informant searched his daughter but no trace was found. Further, his wife told him that five persons named in the F.I.R., including the petitioners used to talk with his daughter in way of school for bad purpose. Thereafter, the informant went to ask about his daughter to the father of Andeep and Rajkumar, they assured him that his daughter she will come after two and three days. The informant

Patna High Court Cr.Misc. No.43479 of 2015 (2) dt.14-10-2015 2/2 was further informed by his wife that Andeep and Ruchi Kumari, daughter of the informant had performed the marriage in the temple.

Learned counsel appearing on behalf of the petitioner submits that in fact, there was love affairs in between Andeep and Ruchi Kumari, daughter of the informant and both moved according to their sweet will, but due to ill motive, the petitioners, who are unmarried sister of co-accused Andeep, have falsely been implicated in the present case.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of his arrest or surrender within six weeks, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., East Champaran at Motihari in connection with Gobindganj (Areraj) P.S. Case No. 109 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C.
