JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363, 365 and 34 of the Indian Penal Code. Allegation is that son of informant has become traceless. It is alleged that petitioner along with other accused persons was seen with the victim in the fair.

It has been submitted on behalf of petitioner that he is in custody since 21.9.2016. He has got no criminal antecedent. Chargesheet has been submitted against petitioner. He has been made accused merely on the basis of suspicion. There is no substantive evidence to suggest his implication in the present case. Other co-accused has been granted bail vide Annexure-2 to the present application.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.51532 of 2016 (2) dt.06-12-2016 2/2 amount each to the satisfaction of learned Judicial Magistrate,Ist Class, Uda-Kishunganj, Madhepura, in connection with Gwalpara P.S. Case no. 115 of 2015.
