The petitioner seeks regular bail in connection with Uchakagaon P.S. Case No. 268 of 2018 for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The allegation of the prosecution is that while the police was conducting checking, it had apprehended a pick-up van, which was being driven by the petitioner herein and 486 liters of illicit liquor was recovered from the said vehicle. The learned counsel for the petitioner has submitted that the petitioner is having a clean antecedent and he was merely a driver of the said pick-up van, which was handed over by the owner of the vehicle. Patna High Court Cr.Misc. No.70514 of 2018(2) dt.12-12-2018 2/2 the owner of the vehicle and he was not knowing as to what articles were kept in the said pick up van. It is submitted that the petitioner has a clean antecedent and is languishing in custody since 14.10.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II cum Special Judge, Gopaganj in connection with Uchakagaon P.S. Case No. 268 of 2018.
