Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. The F.I.R. relates to snatching of a truck by two unknown criminals. The petitioner was arrested in this case by the police without collection of any material against the petitioner. After arrest the petitioner was remanded to judicial custody on 17.04.2016.
Submission is that there is no recovery, no T.I.P. was conducted of the petitioner. The only material is confession of this petitioner before the police.
Learned A.P.P. opposed the prayer for bail on the ground of criminal antecedent of the
Patna High Court Cr.Misc. No.44398 of 2016 (3) dt.13-12-2016 petitioner.
Considering the aforesaid facts, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jehanabad/Successor Court in connection with Kako P.S. Case No. 75 of 2016.
