Heard learned counsel for the petitioners and the State.
The two petitioners are apprehending their arrest in connection with Dehri (Dalmiya Nagar) P.S. Case No. 42 of 2017 (G.R. No. 75 of 2017) for offences under Sections 341, 323, 324, 326/34 of the Indian Penal Code.
From perusal of the FIR of Dehri (Dalmiya Nagar) P.S. Case No. 42/2017, it appears that altercation took place between the petitioners and the informant sides at the hand pump
Patna High Court Cr.Misc. No.20350 of 2017 (2) dt.07-06-2017 2/2 where both the petitioners and the informant sides were taking water for bath or cooking food.
From perusal of the FIR of Dehri (Dalmiya Nagar) P.S. Case No. 43/2017, the counter version of the said case filed by the petitioners' side, it appears that similar allegations were levelled by the petitioner against the informant's side. Having regard to the fact that there is case and counter case, nature of altercation and allegations levelled in the FIR and the fact that the petitioners on affidavit have claimed that they have clean antecedent, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Dehri, district Rohtas or the successor Court in connection with Dehri (Dalmiya Nagar) P.S. Case No. 42 of 2017 (G.R. No. 75 of 2017), subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
