The petitioner apprehends his arrest in Complaint Case No. 410 of 2012 instituted for the offence under Section (s) 406 of the Indian Penal Code.
It has been submitted that petitioner is nephew of the complainant. There is no allegation of overt act against this petitioner.
As per the complaint petition, the brother of the complainant Agahanu Sharma got the sale deed executed with respect to the land in question in favour of his wife instead of executing the sale deed in favour of the mother of the
Patna High Court Cr.Misc. No.7391 of 2017 (2) dt.22-02-2017 2/2 complainant. The petitioner is son of Agahanu Sharma. From the complaint petition itself, it appears that there is no allegation of overt act against this petitioner. In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Complaint Case No. 410 of 2012, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
