JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 Petitioners seek bail in anticipation of their arrest in connection with Sasaram Muffasil P.S. Case No. 640 of 2018 registered for the offences punishable under Sections 30(a), 35 and 38 of the Bihar Prohibition and Excise Act. Allegation against the petitioners is of manufacturing of illicit liquor and police raided the place and recovered 390 litres of liquor and petitioners succeeded in fleeing away. It further appears that petitioners are accused in three other cases. Submission of learned counsel for the petitioners is that they have falsely been implicated and nothing has been recovered from their conscious possession.

No.529 of 2019(4) dt.14-02-2019 2/2 Having heard both sides and in view of allegation and criminal antecedents, I am not inclined to grant privilege of anticipatory bail to the petitioners, rather petitioners to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed.
