Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Petitioner is in custody since 21.10.2019. Petitioner is not named in the FIR relating to occurrence of robbery whereas other two co-accused are named.

Learned counsel for the petitioner submits that the petitioner was arrested in connection with some other case and confessional statement of petitioner before police was recorded and on that basis the petitioner has been remanded in this case also. Except aforesaid, there is no other material against the petitioner. Petitioner was never put on T.I. Parade. No incriminating article was recovered from his possession.

No.22106 of 2020(5) dt.19-01-2021 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.2969 of 2019, arising out of Makhdumpur Police Station Case No.344 of 2019 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
