The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 364 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

The prosecution case is that Anwar Ansari kidnapped the minor daughter of the informant from her house on pistol point, when this petitioner being the mother of Anwar Ansari was present there. Subsequently, the dead body of the daughter of the informant was recovered.

It is submitted by the learned counsel for the petitioner that no overt act has been alleged against the petitioner. She is only roped in the present case because she is

Patna High Court Cr.Misc. No.43023 of 2015 (2) dt.15-10-2015 the mother of Anwar Ansari. The petitioner has not been sent up for trial and differing with the Final Form cognizance has been taken against the petitioner.

Considering the fact that no overt act being alleged against the petitioner, petitioner being a lady and statement being made in para-3 of the petition that petitioner has no criminal antecedent, let the above named petitioner be released on bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 489 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
