JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 447, 353, 327, 504, 506/34 of the Indian Penal Code.

It is alleged that the petitioner along with 10-15 unknown persons abused and assaulted the informant who cut the electric supply of this petitioner due to pending electricity dues.

Learned counsel for the petitioner submits that petitioner has already deposited twenty-five thousand and also gave an undertaking to pay the remaining amount. Whereupon the electricity connection was restored on 27.01.2023. As such, there is no occasion for the petitioner to commit such offence. Learned counsel for the State opposes the bail petition

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Chakia P.S. case no. 31 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
