This is an application for bail in connection with Mufassil P.S.Case No. 76 of 2016 registered for the offences punishable under Section 376 of the Indian Penal Code. Allegation against the petitioner of committing rape upon the informant.

It has been submitted on behalf of the petitioner that though there is allegation of committing rape upon the informant by the petitioner but from the FIR it appears that she was a consenting party and now the petitioner has remained in custody for 11 months and he is ready to abide by any condition that may be imposed upon him if he is granted bail.

Heard learned APP also, who has opposed the prayer

Patna High Court Cr.Misc. No.20789 of 2017 (2) dt.09-05-2017 2/2 for bail.

Having heard both sides and considering the allegation, which has been supported by the prosecutrix in her statement under Section 164 Cr.P.C., I am not inclined to grant bail to the petitioner.

However, as the petitioner is in custody for 11 months, learned trial court is directed to expedite the trial and try to conclude the same within a period of one year. With this observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
