The petitioner seeks bail in N.T.P.C. P. S. Case No. 35 of 2018 instituted for the offence under Section(s) 401, 413, 414, 411 and 34 Indian Penal Code.

Learned counsel for petitioner submits that name of this petitioner has been disclosed by co accused Karu @ Ravindra Kumar who was apprehended by the police. In the written report, it is alleged that police raided the house of this petitioner and recovered an amount of of Rs. 1,93,000/- which was kept after selling the stolen gold in the shop of co accused Bideshwari Prasad Sah and Kundan Kumar. It is further alleged that police recovered two kilogram silver ornaments, golden Mangtika, ear rings and other ornaments

Patna High Court Cr.Misc. No.71202 of 2018(2) dt.10-12-2018 2/2 from co accused Bideshwari Prasad Sah and Kundan Sah. Learned counsel for petitioner submits that petitioner has no concern with the alleged stolen gold. The amount which was found in the house of petitioner was received by him in terms of agreement to sale executed for the land. It has further been submitted that co accused Bindeshwari Prasad Sah and Kundan Kumar @ Kundan Kumar Sah have already been granted bail by co-ordinate Bench of this Court vide Cr. Misc. no. 44933 of 2018.

The petitioner is in custody since 27.7.2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Bhagalpur, in connection with N.T.P.C. P. S. Case No. 35 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
