Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Harnaut (Telmar) P.S. Case No. 239 of 2019 corresponding to Sessions Trial No. 279 of 2020, registered for the offence punishable under Sections 447, 504, 506, 302, 34 of the Indian Penal Code and section 27 of the Arms Act.

Earlier the bail application of petitioner was rejected vide order dated 04.11.2020. Vide order dated 14.07.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'X'), which reveals that two witnesses have already been examined out of five unofficial

Patna High Court CR. MISC. No.32535 of 2021(3) dt.25-08-2021 2/2 chargesheeted witnesses and case is fixed for prosecution evidence.

Considering the nature of allegation and stage of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, as the petitioner is in custody since 23.10.2019, trial court is directed to conclude the trial as early as possible.
