JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Ara Nawada P.S. Case No. 288 of 2012 registered under Sections 419, 420, 468 and 471 of the Indian Penal Code. From the prosecution case, it would appear that the petitioner had appeared in physical test examination conducted for recruitment of Constables in the name of one Minesh Kumar. It is contended that the name of the petitioner transpired on the basis of confession made by the co-accused Minesh Kumar, who has already been granted bail by the learned Sessions Judge.

Be that as it may, regard being had to the facts and

Patna High Court Cr.Misc. No.43353 of 2015 (2) dt.13-10-2015 2/2 circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the application under Section 438 of the Code of Criminal Procedure is rejected. In case the petitioner surrenders and seeks bail, the same shall be considered on its merit without being prejudiced by the order of this Court.
