The petitioner apprehends his arrest in Teghra P.S. Case No. 26/2018, registered for the offences punishable under Section(s) 30/30(a) of Bihar Prohibition and Excise Act, 2016. 243 litres of foreign liquor has been recovered from the orchard of one Nishu Kumar.
It has been submitted on behalf of the petitioner that name of this petitioner has come on the basis of confessional statement of co-accused Rahul Kumar. Petitioner has no concern with seized liquour or with the orchard. Nothing has been recovered from possession of this petitioner. Petitioner has got no criminal antecedent. Other co-accused Nishu Kumar has already been granted anticipatory bail by this court vide order
Patna High Court CR. MISC. No.27236 of 2019(3) dt.17-07-2019 2/2 dated 19.07.2018 passed in Cr. Misc. No. 43159/2018. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge Excise Act, Begusarai in connection with Teghra P.S. Case No. 26/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
