JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 326, 379, 435, 120(B), 302 & other minor sections of the Indian Penal Code, 27 of the Arms Act, 17 of CLA Act and under Sections-30, 10, 16, 12, 20, 21, 38 of UAP Act. Petitioner is named in the first information report along with others but no specific overt act has been attributed against the petitioner. Moreover, having more or less similar allegation, coaccused Rajendra Yadav and some others have already been granted privilege of bail by this court. The petitioner does not have any criminal antecedent and is languishing in jail custody since 04-04-2016.

Considering the above-said facts and circumstances of

Patna High Court Cr.Misc. No.44655 of 2016 (4) dt.15-12-2016 2/2 the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barachatti (Mohanpur) P.S. Case No. 528 of 2013 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati at Gaya.
