The petitioners are apprehending their arrest in a case registered under Sections 498A and 306 of the Indian Penal Code.
The prosecution case, in short, is that the informant, Choukidar of Isuapur P.S., has alleged that on 26.03.2016 she got information that death of the wife of Bipin Singh has been occurred due to burn injury and she went there to enquire the matter and during course of quarry she came to know that deceased had set fire on her body due to torture by her in-laws and she died due to burn injury.
It has been submitted on behalf of the petitioners that the
Patna High Court Cr.Misc. No.69892 of 2018(2) dt.27-11-2018 2/2 petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioner No.1 is father-in-law, petitioner No.2 is mother-in-law and petitioner No.3 is Devar of the deceased. They are separate in mess and property from the husband of the deceased. They have got no concern with the alleged occurrence.
On behalf of the State, it is submitted that the petitioners are named in the complaint case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Saran at Chapra in connection with Isuapur P.S. case No.39 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
