JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-09-2020 Heard Mr. Ravi Kumar, learned counsel for the petitioner and Mr. Bhanu Pratap Singh, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner seeks regular bail in connection with Narkatiaganj Rail PS Case No. 87/2019 registered for the offence punishable under Sections 379, 411 of the IPC.

3. The allegation against the petitioner as per First Information Report is that the petitioner along with other accused persons were caught on the spot while they were picking pocket in the train.

4. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedents. Learned counsel further submits that the money which was allegedly pickpocketed from the pocket of informant has been recovered from the co-accused, Vinod Mahto. Learned counsel for the petitioner further submits that one piece of blade and a scissor were recovered from the pocket of the petitioner and petitioner is in

5. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner has got no criminal antecedent and is under custody since 20.10.2019, I am inclined to grant regular bail to the petitioner subject to the condition that petitioner will not commit similar offence in future in which, presently, he is an accused.

Accordingly, let the petitioner, ANAND KUMAR SRIVASTAVA @ RAJU KUMAR be released on bail, if he is not required in any other case, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bettiah, West Champaran in connection with Narkatiaganj PS Case No. 87/2019.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
