This application for regular bail arises out of Mehandiganj P.S. Case No. 58 of 2018, Sessions Trial No. 19 of 2019, disclosing offence punishable under Section 302 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner had earlier approached this Court for grant of regular bail, which was rejected by this Court by an order dated 06.08.2019, passed in Cr. Misc. No. 32564 of 2019 after perusing the case diary. The petitioner has not been able to make out any fresh ground for renewal of his prayer for bail except his continued incarceration.
It appears that the trial has progressed and some of the
Patna High Court CR. MISC. No.22230 of 2020(2) dt.03-09-2020 2/3 witnesses have already been examined. In such circumstance, I am not inclined to entertain this second application for grant of regular bail.
This application is accordingly rejected.
The petitioner shall be at liberty to renew his prayer for bail after six months if, in the meanwhile, there is no progress in the trial.
It is directed that defects in the application pointed out by the Registry must be removed within two months from today. Since there is a lockdown, the Court has considered it appropriate to adopt following procedure for communication of the present order:- (i) The order, which has been dictated during the course of the proceedings of virtual Court, shall be communicated to me on my e-mail I.D. by the Secretary. (ii) The corrected copy of the order shall be transmitted by me from my e-mail I.D. to the Secretary, which shall be treated to be the authentic copy of the order passed by this Court today in the present proceeding.
(iii) Hard copy of the order, duly signed by me, shall be preserved in my residential office for documentation and future use, if any.
