JUSTICE SANJAY PRIYA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in Obra P.S. Case No.108 of 2016 instituted for the offence under Sections 409 and 420 of the Indian Penal Code.
As per prosecution report filed by the Block Education Officer, in terms of the order of the Hon'ble High Court, the relevant certificates and papers were to be verified, but the petitioner did not hand over the folder file in spite of request. It has been submitted on behalf of the petitioner that the entire allegation made in the written report is totally vague. It has not been mentioned when the folder file was demanded from the petitioner and by what letter. It has further been submitted that
Patna High Court Cr.Misc. No.3592 of 2017 (2) dt.09-02-2017 the petitioner has already retired on 31.07.2014, whereas from the written report it appears that the notice was issued on 26.07.2016 to submit the folder file.
In view of such, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Obra P.S. Case No.108 of 2016, he shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad, subject to the conditions as laid down under Section 438(2) Cr.P.C.
