JUSTICE SANJAY PRIYA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 47 (a) of the Bihar Excise (Amendment) Act, 2016.

It has been submitted that the petitioner was not present on the spot. The seizure was made in Maini village and it is alleged that 10 liters of country made liquor has been recovered. From the seizure list it is not clear that the alleged country made liquor has been recovered from the house of the petitioner. No copy of seizure list was provided to any of the family member of the petitioner. The petitioner is a lady.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.3630 of 2017 (2) dt.10-02-2017 2/2 let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Rupauli P.S. Case No. 110 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri L.B. Paswan, learned Judicial Magistrate, 1st Class, Purnea, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
