2. In the present case, the petitioners seek bail in connection with Ghogha P.S. Case No. 90 of 2024, registered for the offences under Sections 103(1), 80 (2), 238, 3(5) of BNS, 2023 and Section 3⁄4 of DP Act.
3. As per the prosecution case, marriage of the daughter of the informant was solemnized with co-accused Sonu Jha @ Sunit Jha and it was a love marriage. The daughter of the informant died within two months of marriage and the allegation against the petitioners and other co-accused persons is that they killed her on account of non-fulfillment of demand of a motorcycle and Rs. 1 lac in dowry. The petitioners are the
2/4 parents-in-law of the deceased.
4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. No occurrence as alleged has ever taken place. The allegation of assault or demand of dowry is not believable as it was a love marriage and the informant and her family broke up the relationship with the deceased and her in-laws. It is also not believable that within two months of marriage, the petitioners, who are old parents-in-law and other family members, would demand dowry and kill the daughter of the informant. Even the FIR was lodged after deliberation and as an afterthought as the informant claims to have received information on 17.07.2024, but she lodged the FIR only on 19.07.2024 without any explanation. The learned counsel further submits that the petitioner no.
1 is mentally sick and has been undergoing treatment and a number of witnesses examined by the police during investigation stated about this fact. The learned counsel further submits that during investigation, the neighbours stated that the daughter of the informant died due to severe pain in her abdomen and she suddenly died due to this pain while being taken to the hospital. The co-accused husband is already in custody. The petitioners are in custody since 06.02.

5. Learned A.P.P. vehemently opposes the submission made on behalf of the petitioners.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the doubtful nature of allegation against the petitioners and further considering the relationship of the petitioners with the deceased and also considering the period of custody of the petitioners and their clean antecedents, the petitioners are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Bhgalpur/concerned court, in connection with Ghogha P.S. Case No. 90 of 2024, subject to the condition laid down under Section 480 (3) of the BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the below, if so required by the learned trial court.
(iii) In case of absence on three
4/4 consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
